So, ..., you are right they can be established, but the interplay with registered trademarks is complicated. Here's a reasonable article on it: http://www.fr.com/news/prior-user-vs-federal-registrant-whos...

  3. > Patents are property and we need taxes/fee on it. $500/year per patent Those 'taxes' already exist (at least in the US system). They are called "maintenance fees". See https://www.fr.com/insights/ip-law-essentials/everything-abo... Failing to pay the fee causes the patent to expire, and be unable to be used to sue someone. So these troll firms must also be paying these fees to be able to sue based on the patent.

  5. A lot of people are wondering why the FCC has jurisdiction over this. The reason is that Swarm is operating an unauthorized experimental radio station on American soil. [0] That's always been illegal, as it should be. That shouldn't be the end of the discussion, though. Why didn't the FCC grant Swarm a license in the first place? Basically, the FCC claims the right to take action to minimize the danger of orbital de…

  6. this is not at all like blaming bittorrent sites for pirating look, you don't understand what this seed cleaner was doing. monsanto does not go around suing every seed cleaner in the midwest just because they could be cleaning roundup ready seeds. they sued moe parr, and they did so because he told other farmers that it was legal for them to clean their roundup ready seeds (which it is not). evidence: http://www.fr.…

  7. look, if you think a news article quoting Moe Parr about someone suing him is convincing evidence, i'm not really sure if you'll believe this, but here's some evidence indicating that Moe Parr is in the wrong: this is the court injunction against Moe Parr's seed cleaning activities: http://www.fr.com/files/uploads/publications/DSU-Medical-Cor... i hope your mind isn't already made up

  8. As others pointed out, you need an hour with a labor lawyer. Fish and Richardson, the law firm, says "Employees: Non compete agreements - don't sign them.[1] It's often effective to take the contract, cross out and initial sections you and your lawyer consider overreaching, sign that, and turn it in. Then the company has to argue with you paragraph by paragraph, tying up their legal counsel, if they really want thos…
