HN discussionThe way US prosecutors operate - piling on large numbers of felony charges with decades in maximum sentencing and offering a shorter sentence in exchange for a guilty plea - is a clear violation of the 8th Amendment. It's functionally equivalent to using the threat of torture to extract a confession. http://quandyfactory.com/blog/103

HN discussion> As for "threats of 35 year sentences"--the statutory maximum is not a "threat." That's simply incorrect. It is absolutely a threat. As I recently argued: > The prosecutor used the threat of 35-50 years in prison to get Aaron to accept a guilty plea. If he chose to plead not guilty and attempt to defend himself, it would cost well over a million dollars in legal fees, and if he were found guilty anyway, the judge w…

HN discussionWrong, wrong, wrong. The only way he didn't face 35 years of prison time is if he was prepared to plea guilty despite believing firmly and with sound reason that he was not a criminal. As I've argued elsewhere [1], "A prosecutor forcing someone to admit guilt by threatening a life-destroying cruel and unusual punishment if they do not admit it - why, that is the very essence of using torture to extract a confession!…

HN discussionI don't disagree with you on the need for careful refactoring of our legal code. In fact, a few years ago I wrote an essay on this very topic: http://quandyfactory.com/blog/30/software_as_a_model_for_gov... I do believe we need to exercise caution, balance and good judgment, and that most of the time, careful refactoring is more prudent and effective than throwing out the existing code and starting from scratch.
